Terms and Conditions

Welcome to WebBitFlow. By hiring our web development, digital marketing, or technology consulting services, you agree to comply with the following terms and conditions. These terms govern the professional relationship between the client and our agency.

1. Scope of Services

WebBitFlow commits to executing the services described in the Quote or Technical Proposal previously sent and accepted by the client. Any additional requirements, design changes, or functionalities not specified in the initial document will be considered a “Change Request” and will be quoted independently.

2. Workflow and Deliverables

To ensure project success, we work under a milestone-based delivery schedule:

• Planning Phase: Definition of structure and design.
• Development Phase: Programming and tool configuration.
• Review Phase: Testing period by the client. The client agrees to provide all necessary materials (text, logos, access credentials) within no more than 5 business days after the start. Delays on the client’s part will directly affect the final delivery date.

3. Payment Terms and Invoicing

In compliance with the MYPE tax regime (Peru), our conditions are:

• Deposit: An initial payment of 25% is required to reserve operational capacity and initiate the project.
• Final Payment: The remaining 75% must be settled upon final approval and prior to deployment on the production server or delivery of credentials.
• Invoices: We issue electronic receipts (Boleta de Venta) or Invoices (Factura) as requested by the client. Prices do not include IGV (VAT) unless otherwise specified in the quote.

4. Intellectual Property

• Client’s Rights: Once 100% of the payment is settled, the client owns the visual assets, databases, and website content.
• WebBitFlow’s Rights: We retain ownership of our working methods, proprietary frameworks, developer licenses, and base source codes. Furthermore, WebBitFlow reserves the right to include the project in its commercial portfolio and add a small “Developed by WebBitFlow” link in the website footer.

5. Warranty and Technical Support

We offer a 30-calendar-day technical warranty starting from the launch date. This warranty covers:

• Programming errors (bugs).
• Display issues in modern browsers.
• Malfunction of forms configured by us. The warranty does not cover errors caused by client tampering, third-party plugin updates after delivery, or issues with the hosting server if it is not managed by us.

6. Cancellation and Refunds

• If the client cancels the project before development begins, the deposit will be refunded minus 40% for administrative and planning costs.
• If development has already started (Phase 2 onwards), the 25% deposit is non-refundable, as it covers the man-hours and technical resources already invested.

7. Confidentiality

Both parties agree not to disclose strategic information, server access, or trade secrets shared during the project’s execution, protecting each other’s competitive advantage.

8. Governing Law and Jurisdiction

For any controversy arising from this contract, the parties submit to the current legislation of the Republic of Peru and the jurisdiction of the courts of the city of Lima.
